A local doctor accused of sex-assault allegations could soon face the Supreme Court, according to a law firm.
Adviceline Injury Lawyers confirmed it commenced court proceedings against former Ocean Grove GP Shafiul Milky this week.
A former patient who alleges Dr Milky sexually assaulted her on “multiple occasions”, is seeking damages for the “psychological injury” she suffered as a result, according to Adviceline Injury Lawyers.
Adviceline Injury Lawyers managing partner Bree Knoester said the firm is also considering further action on behalf of two more former patients.
“We have now spoken to many former patients of Dr Milky and received numerous accounts of alleged inappropriate touching,” said Ms Knoester.
“Patients are also expressing great distress at revealing what occurred and are often recounting what occurred for the first time to anyone.”
The development comes as Dr Milky won the right to work again after the Victorian Civil and Administrative Tribunal (VCAT) granting an interim stay of his suspension last November.
The stay will lift his ban until a further hearing next March, according to VCAT.
Dr Milky can now practice at three “approved” locations in Colac and Mount Clear under gender-based restrictions, according to the Australian Health Practitioner Regulation Agency (AHPRA).
The Medical Board of Australia (MBA) previously banned Dr Milky from seeing female patients last March before suspending his registration in September.
Dr Milky has denied all the allegations. Both police and AHPRA are investigating the claims.
