A man charged over a Corio shooting would have used the gun to kill the victim if he had the chance, a Geelong court heard yesterday.
Thirty-four-year-old Troy Fox had earlier told the court he was innocent and did not “go around shooting people”.
Fox told Geelong Magistrates’ Court he would leave the city and stay out of trouble if he won his application for bail.
“My methadone treatment can be transferred to Melbourne and I’m sick of Geelong. I don’t know what help I can be to my pregnant fiancé while I’m behind bars,” Fox said.
Magistrate Michael Coghlan refused the application.
“You (Mr Fox) are facing a very serious charge and have a history of breaching court orders,” Mr Coghlan said.
“Police are concerned you will commit further violence.”
Police charged Fox and his fiancee, Hannah Dick, 18, both of Yooringa Avenue, Norlane, over the July 30 shooting of a 28-year-old man.
The man turned up at Geelong Hospital with severe tissue and bone damage from a shotgun blast to his leg.
Fox and Dick were charged with intentionally causing serious injury and a range of firearm offences.
Detective Senior Constable John Bakas said police had received an anonymous call that led to the arrest of Fox and Dick.
“A warrant was taken out on their residential address where we located live ammunition and a spent cartridge in Ms Dick’s clothing drawer,” Sen Cont Bakas said.
Police interviews with Fox and Dick returned three conflicting stories.
“Ms Dick said the victim entered the house with a shotgun and she disarmed and shot him. Mr Fox was nowhere near the house,” Sen Const Bakas said.
He told the court police believed Fox was the shooter.
“Given the physical statue of the victim, I don’t believe a female could have physically disarmed and shot the victim,” Sen Const Bakas said.
Fox told the court he was “out getting cigarettes” when the victim was shot.
Fox said the victim had taken large quantities of the drug Benzodiazipan before he was shot.
“(He) was under the influence and, given the strength of Benzodiazipan, it had knocked him about, so he was easy to disarm,” Fox said.
Sen Const Bakas said the victim had refused to give his side of the story.
“He hasn’t made a statement out of fear of Mr Fox,” Sen Const Bakas said.
