Man raped his son’s girlfriend, court told

A Lara man raped his son’s 17yearold, mentally disabled girlfriend, a court heard yesterday.
Geelong Magistrate’s Court heard the victim alleged her boyfriend’s father raped her at a Lara farm on January 19, 2006.
Detective Sergeant Andrew Foot told the court the 17yearold reported the rape with her mother later in the day.
The alleged victim was “crying and hysterical”.
Det Sgt Foot said forensic scientists examined the girl’s shorts and underwear for DNA evidence but the results were inconclusive.
Det Sgt Foot told the court the alleged rapist denied attacking the girl.
Det Sgt Foot said the accused told him the 17yearold had wanted to have sex with him but he refused.
The accused pleaded not guilty to three counts of rape, two of indecent assault and one of attempted rape.
His barrister, Patrick Bourke, said the girl, a 13yearold friend and the 16yearold son were plotting to give the father a bad name.
Mr Bourke told the court the son had used the allegation in a bid to leave Lara so he could live with his mother at Stawell, in western Victoria.
The court heard the girls went to the father’s house with the son for a sleepover on the day of the alleged rape.
The victim’s friend told the court she was outside with the boyfriend while the victim remained in the house with the father for one to two hours.
The friend said the victim told her earlier in the day that she had a “funny feeling” at the house.
The father had touched the alleged victim’s arm and “she wanted to go home”, the friend said
The friend told the court she witnessed the father giving the mentally disabled alleged victim marijuana.
The court heard that after the alleged rape the father drove the two girls and his son to the victim’s house.
The son, who the court heard was illiterate, said his first statement about the alleged attack was false.
He said the two girls had helped him make the allegations and they discussed the plans before going to the father’s house.
Magistrate Ronald Saines ordered the alleged rapist to appear in Melbourne County Court on Wednesday for a directions hearing.
